Curriculum Vitae

Franz Albert Hofmann began his law studies at the University of Vienna in 1904 after graduating from the Schottengymnasium, graduating in 1911 with a doctorate in law. He became a member of the "Akademischer Lese- und Redevereins christlich-deutscher Studenten" in Vienna. When the Amelungia student fraternity emerged from this association in 1907, he was one of its founders. In 1909, he entered judicial service and first became a judge in Wr. Neustadt and then in Neunkirchen. In October 1914, he passed the examination to become a judge.

After the First World War, during which he ultimately held the rank of senior lieutenant auditor, he was transferred to the Vöcklabruck District Court. In 1930, he moved to the Frankenmarkt District Court, where he worked as a regional court councillor and head of court and in 1936 as a higher regional court councillor. He is also a functionary of the Patriotic Front.

On March 12, 1938, I was arrested at 4:15 a.m. at the request of the district leadership of the NSDAP Vöcklabruck in my official apartment in Frankenmarkt, where I suffered a heart attack as a result of the commotion, so that medical help had to be called. I was declared medically fit for transport by telephone and taken by car to the Vöcklabruck district authority, from where I was released to house arrest in my Vöcklabruck apartment. I was held under house arrest until April 23, 1938, i.e. for 43 days.

Franz Albert Hofmann on his arrest

Franz Albert Hofmann is a strict opponent of the National Socialists. This divides the NSDAP circuit line on 5. May 1938 to the President of the Wels District Court.

In line with his convictions, he was a fierce black man and an equally staunch VF advocate. Because of his convictions, he naturally hated anything that professed to be nationalist and therefore sought to render it harmless. For this reason, he applied the law as best he could at every opportunity.

In addition, he is accused of discrimination in "post assignments" and harassment of "established party members", among other things.

However, at any time, I have given my office as a judge full impartiality to my judge's oath and my office as a district leader of the VF has always exercised the principles of humanity.

Franz Albert Hofmann on his accusations

At the end of this month, I will remove you from the active service and wish you well-being for the future.

From the dismissal letter dated 30. May 1938

With effect from 31. December 1938, according to the decision of the Reichstatthalter of 20th December 1938 “on the basis of § 4, paragraphs 1 and 3 of the Vdg. on the reorganization of the Austrian Professional Competition of 31 December May 1938’reduced to half‘. He's under police surveillance from there and he's back in Vöcklabruck. He's released by forced retirement.

After the war, Franz Albert Hofmann is fully rehabilitated and re-enacted in the judicial service. In May 1945 he took over the provisional leadership of the Vöcklabruck District Executive. Because of his heart disease, he's only working briefly as a judge.
